The U.S. Marshals Service has protected the federal judicial process as the enforcement arm of the federal courts since 1789.
28 USC 566 . Powers and duties(a) It is the primary role and mission of the United States Marshals Service to provide for the security and to obey, execute, and enforce all orders of the United States District Courts, the United States Courts of Appeals
The U.S. Marshals Service is housed in the Department of Justice.
Now, Federal Judges are considering chartering a security force, separate from the U.S. Marshal Service, because they are not confident that the sitting President and Attorney General of the United States won't renege on the lawful obligation of U.S. Marshals to protect them.
On May 25, 2025, retired federal judge J. Michael Luttig wrote:
The Wall Street Journal had a piece last night that the Judicial Conference of the United States — the policy making body for the federal judiciary — is discussing whether the Judiciary should have its own armed security force rather than rely on the U.S. Marshals for federal judges' protection.
The Marshal's Service has historically provided security protection for federal judges. But the Marshal's Service is housed in the Department of Justice and reports to Attorney General Pam Bondi and Donald Trump, both of whom have been viciously attacking the Federal Judiciary and even individual judges who have ruled against Trump and his Administration over the past four months, in escalation of the President's war on the Federal Judiciary, America's system of justice, and the Rule of Law. Pam Bondi recently said on national television that judges are "deranged" and think they are above the law.
It is an extraordinary and unprecedented development in American history that the Nation's Federal Judiciary would have to consider having its own security force because federal judges cannot trust the U.S. Marshal's Service under this President and his Attorney General. They cannot trust this president and this Attorney General to ensure their protection.
In discussing this extraordinary development with Ali Velshi this morning, I had to admit that, given the continuing unprecedented and vicious personal attacks and threats on the federal courts and federal judges by the President, Vice President Vance, Attorney General Pam Bondi, and Donald Trump's Cabinet and senior White House advisors, I would never rely upon the U.S. Marshal's Service for my protection, were I still a sitting federal judge. How could anyone?
